1. General Terms and Conditions:
1.1. These general terms and conditions constitute a legally binding agreement between you and this website “Zameenin.Com” (including any subdomains thereof) (“Site”) regarding use of this Site and any services offered or made available via the Site and/or any mobile/tablet app/s.
1.2. The Site reserves the right to amend or modify these Terms without any prior notice or intimation. Such modifications shall become effective immediately upon being posted on the Site. You are advised to review the Terms periodically to remain informed of any changes. Any further access to the Site after such modifications shall constitute your conclusive acceptance of the revised Terms.
1.3. The Site also reserves the right to temporarily suspend operations of the Site for maintenance, technical upgrades, content updates, or any other purpose, without prior notice to the user.
2. Who We Are:
2.1. Our Site is an intermediary as defined under Section 2 (w) of Information Technology Act, 2000, and provides a platform in technology service which enables:
(a) Agents/brokers and similar intermediaries (“Agents”) to publish land listings; and
(b) Developers and other interested parties (“Developers”) to discover the land listings and contact Agents.

2.2. We are not a real estate broker, real estate agent, property dealer, developer, title investigator, legal advisor, surveyor, valuator, or financial advisor. We do not own, control, or possess any listed land unless expressly stated in writing.
2.3. We do not guarantee that any listing will result in a transaction.
3. Definitions:
3.1. “Listing” means and includes information of the land i.e. the location, area, price/expectation of prices, photos of land, videos of land, information of the landowner, title status, and all related documents posted on the Site by the Agents;
3.2. “User” means and includes any Agent, Developer, Advertiser, Browser, or Visitor either an individual or a juristic personality, whose details are captured in the application form, and includes their successors and permitted assigns. It also includes any person accessing or using Services for hosting, publishing, listing, transacting, or viewing information, or otherwise participating in any manner.;
3.3. “Transaction” shall mean and include any Sale, Lease, Development Agreement, Memorandum of Understanding, Letter of Intent, Term Sheet and/or any other arrangement entered between the Agents and the Visitor;
3.4. “Confidential Information” shall mean and include any and all non-public, proprietary, technical, financial, strategic, commercial, operational or business-related information, data, documents, trade secrets, know-how, customer lists, pricing strategies, product designs, marketing plans, and any other information disclosed by this Site or its affiliates, in any form or medium (whether oral, written, digital or otherwise), whether marked as confidential or not, to the other party in connection with the Term
4. Eligibility:
4.1. Users must be competent to Contract under the Indian Contract Act, 1872;
4.2. If a User is a minor (under 18 years) or otherwise not competent to contract, such User must not use the Site to negotiate, execute, or conclude any Transaction. Any access/use by a minor shall be only under the supervision of a parent/legal guardian, and any action taken on the Platform shall be deemed to have been taken by such parent/legal guardian. The Site shall not be responsible for any Transaction, commitment, payment, or representation made by a minor. The User/guardian shall be solely responsible for consequences arising from any minor’s access or dealings;
4.3. The Users agree to provide accurate information and keep the same updated.
5. Platform Services:
5.1. The Site provides the following services on its platform:
(a) Posting land listings and User profiles for Sale;
(b) Search Engine for the lands available for Sale in India;
(c) Placing advertisements on this Site;
(d) Other services as mention in the Site and/or stated in the Terms and Conditions

5.2. The features of this Site maybe changes, paused or discontinued at the Site’s discretion.
6. No Verification/Due Diligence Disclaimer:
This Site does noy independently verify listings, title, encumbrances, ownership, possession, zoning, land use, access, litigation, acquisition risks, easements, survey boundaries, environmental compliance, NA permissions, DP reservations, FSI/TDR, or any approvals in respect of the lands listed. It is further stated that any “verified” / “featured” / “recommended” tag (if used) refers only to internal checks (e.g., KYC of Agent or document upload presence) and does not mean legal verification of title or suitability.
7. Users Obligations:
7.1. Developers/Buyers Obligations:
(a) The Developers/Buyers of the land listed agree that prior to the Transaction, it shall be their responsibility/obligation to conduct a full due diligence in respect to the land they intend to buy through the listing provided on the Site. The Due diligence shall include title search, 7/12 or equivalent land records, mutation entries, EC search, encumbrance checks, litigation checks, survey, access, zoning/DP checks, and all regulatory approvals.
(b) It is further agreed by the Developers/Buyers that it shall be their responsibility to verify the Agents’ authority/mandate and the landowner’s capacity and authority in respect of the Transaction. It is the responsibility of the developer to conduct their own legal, technical and financial diligence in respect to the land listed prior to the Transaction.
(c) It has been agreed by the Developers/Buyers that if any transaction is cancelled, terminated, rescinded, delayed, and/or disputed for any reason whatsoever (including change of mind, due diligence findings, title defects, regulatory issues, pricing disputes, non-performance, or breach by any party), the Site shall not be responsible or liable for any loss, damages, costs, forfeiture, or consequences arising therefrom.
(d) In view of the aforesaid, any advance, token, earnest money, booking amount, consideration, or payment (if any) paid by the Developers/Buyers to any third party is at the Developer/Buyers sole risk, and the Site shall have no responsibility for refund, recovery, or enforcement.
(e) The Developers/Buyers agree that they shall use the Site only for the purposes of lawful business.
(a) The Developers/Buyers of the land listed agree that prior to the Transaction, it shall be their responsibility/obligation to conduct a full due diligence in respect to the land they intend to buy through the listing provided on the Site. (b) It is further agreed by the Developers/Buyers that it shall be their responsibility to verify the Agents’ authority/mandate and the landowner’s capacity and authority in respect of the Transaction. 7.2. Agents/Sellers Obligations:
(f) The Agents/Sellers have valid authority/mandate/license to list the land on the Site. The Agents/Sellers agree to produce such authority/mandate/license on request.
(g) The Agents/Sellers shall assure that all listing information in respect of the land is true, accurate, current, not misleading, and supported by documents where applicable.
(h) The Agents/Sellers shall not upload false listings, dummy inventory, manipulated images, or misrepresent title/possession/price/area of the land listed on the Site.
(i) The Agents/Sellers shall comply with all applicable laws (including local real estate rules), and maintain required registrations/permissions (if any apply to their operations).
(j) The Agents/Sellers shall promptly update listing status (available/under negotiation/sold/withdrawn) and remove outdated listings.
(k) The Agents/Sellers are solely responsible for communications, site visits, negotiations, and transaction documentation with Developers/landowners.
(f) The Agents/Sellers have valid authority/mandate/license to list the land on the Site. The Agents/Sellers agree to produce such authority/mandate/license on request.

(j) The Agents/Sellers shall promptly update listing status (available/under negotiation/sold/withdrawn) and remove outdated listings.
(k) The Agents/Sellers are solely responsible for communications, site visits, negotiations, and transaction documentation with Developers/landowners.
8. RERA Disclaimer and Compliance:
8.1. The Site is a technology and advertising medium that displays land listings and related information uploaded by Agents and/or third-party advertisers. The Company does not act as a real estate agent/broker, promoter, developer, or facilitator of sale/purchase and does not undertake any activity requiring registration under the Real Estate (Regulation and Development) Act, 2016 (“RERA”), except to the extent (if any) mandated by applicable law.
8.2. Certain real estate projects, plotted developments, or transactions advertised on the Platform may fall within the scope of RERA and may require registration with the applicable State Real Estate Regulatory Authority (“Authority”). The Site does not represent that any Listing is RERA-registered, exempt, or compliant.
8.3. The Site reserves the right to suspend/remove any Listing or advertisement that, in its sole discretion, appears to violate RERA or any applicable law, or upon receipt of a complaint, notice, or direction from a competent authority. The Company may share relevant information with authorities as required by law.
8.4. Agents/advertisers agree to indemnify and hold harmless the Site from any claims, penalties, actions, losses, or expenses arising out of or related to (a) non-compliance with RERA or (b) inaccurate/misleading advertisements or disclosures provided by the Agent/advertiser.
9. Prohibited Conduct:
9.1. Users shall not permit unauthorized persons to access or use the Services, nor shall they resell, sublicense, assign, or commercially exploit the Services or any listing in any unauthorized manner.The Services must only be used for its intended and subscribed purpose and in compliance with applicable Indian laws, regulations, and platform terms.
9.2. User are prohibited from posting, transmitting, or storing content that is defamatory, obscene, pornographic, paedophilic, abusive, threatening, harassing, libellous, racially or ethnically objectionable, or otherwise unlawful or harmful.
9.3. Content that endangers India's sovereignty, security, unity, foreign relations, public order, or promotes incitement of cognizable offences is strictly prohibited.
9.4. User must not impersonate any person or entity, misrepresent their affiliation, or disclose confidential or proprietary information without proper authorization.
9.5. Uploading or transmitting viruses, malware, or malicious code; attempting unauthorized access to systems, networks, or the Site; or using bots, scrapers, or similar tools without permission is strictly prohibited.
9.6. User shall not print, download, delete, amend, or misuse data posted by others, nor shall they use third-party data without consent except for lawful transactions.
9.7. User must not share false, misleading, or deceptive information, or any content created with malicious intent to harm or misinform others. Sending unsolicited messages, engaging in spamming activities (including redirection from other platforms), or advertising unrelated Services to other users is not allowed.
9.8. Violation of these Terms may result in suspension, deactivation, or blacklisting of the User.
10. Confidentiality and Handling of Data
10.1. The User shall treat any non-public information or documents received through the Platform (including location coordinates, ownership details, title papers, layouts, feasibility notes, pricing expectations, contact details, etc.) as confidential and shall use them only for evaluating a bona fide Transaction.
10.2. The User shall not misuse, publish, forward, sell, or distribute any such information to any third party except: (i) to its professional advisors (lawyers, architects, surveyors, consultants) on a need-to-know basis under confidentiality; or (ii) where disclosure is required by law or court order.
10.3. The Site implements reasonable security measures, the User acknowledges that transmission over the internet is not fully secure. The Site will handle personal data in accordance with its Privacy Policy. The Site shall not be liable for unauthorised access beyond its reasonable control (e.g., cyber incidents, telecom/network failures, third-party attacks).
11. Intellectual Property:
11.1. All logos, brand names, trademarks, service marks, domain names, trade dress, and related identifiers (“Marks”) displayed on or in connection with the Platform are owned by the Site and/or its affiliates and/or are used under valid licence/permission from third parties. All rights, title and interest in and to the Marks vest solely with their respective owners.
11.2. Nothing on the Platform shall be construed as granting the User any licence, right, or permission to use any Marks, whether by implication, estoppel, or otherwise. Any use of the Marks without the Site’s (or the relevant owner’s) prior written consent is strictly prohibited and may constitute an offence and/or give rise to civil and/or criminal liability under applicable Indian laws.
11.3. Except for User Content (as defined below), the Platform, the Services, and all underlying software, layout, design, databases, text, images, graphics, audio/video, and other materials (“Platform Content”) are owned by or licensed to the Site and are protected by intellectual property laws. Users shall not copy, reproduce, modify, distribute, publicly display, reverse engineer, or create derivative works from Platform Content except as expressly permitted under these Terms or applicable law.
11.4. The Site respects intellectual property rights and expects Users to do the same. Users must ensure that any content, images, documents, descriptions, or other material uploaded or posted by them (“User Content”) does not infringe any third-party intellectual property rights. Where the Site becomes aware, or reasonably believes, that any User Content infringes intellectual property rights, the Site may remove/disable access to such content and/or suspend or terminate the User’s account, with or without notice, and without prejudice to the Site’s other rights and remedies.
11.5. Subject to the User’s ongoing compliance with these Terms, the Site grants the User a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform and the Services solely for the User’s internal business purposes and only in the manner permitted under these Terms. This licence does not include any right to copy, scrape, reproduce, distribute, resell, or commercially exploit any portion of the Platform or the Services except as expressly authorised in writing by the Site.
12. Third-Party Links and Services:
The Site may include third-party links (including advertiser links) and services (e.g., maps). We are not responsible for third-party content, services, or availability.
13. Limitation of Liability:
13.1. To the maximum extent permitted under applicable law, the Site shall not be liable for any loss or damage arising out of or relating to (i) the User’s access to, use of, or inability to use the Services, (ii) any content, listings, advertisements, communications, or links made available on or through the Site, or (iii) any act or omission of any third party (including Agents, advertisers, or other Users). This limitation applies to all claims, whether based in contract, tort, statute, strict liability, warranty, misrepresentation, negligence, or any other legal theory, and includes without limitation any direct, indirect, special, incidental, exemplary, punitive, or consequential damages, loss of profits, loss of business, loss of goodwill, loss of data, or business interruption, even if the Site has been advised of the possibility of such damages.
13.2. The Site assumes no responsibility and shall not be liable for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, system downtime, unauthorised access to, or alteration of, User information or communications. The Site does not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. The Site shall not be responsible for any technical malfunction of the internet, networks, servers, hosting providers, third-party systems, computer equipment, software, email delivery, or traffic congestion, including any damage to a User’s device or data resulting from use of the Platform or downloading any content/material.
13.3. The Site may contain listings, advertisements, sponsored placements, content, or links provided by third parties. The Company does not control, verify, endorse, or assume responsibility for any such third-party content, including the accuracy, legality, completeness, availability, or reliability of any listing/advertisement or the conduct of any Agent/advertiser/User. Any engagement, negotiation, visit, payment, or transaction with third parties is solely between the relevant parties, and the Site is not a party to the same.
13.4. The Site shall not be liable for any inaccuracy, error, or omission in any information displayed on the Platform, including any listing details such as price/expectation, area, location, boundaries, title status, approvals, zoning, or availability. Users (including Developers) must conduct their own independent due diligence and obtain professional advice before entering into any arrangement or Transaction.
13.5. While the Site implements reasonable security practices, the Company does not guarantee absolute security of information transmitted through the Platform or over the internet. The Site shall not be liable for any unauthorised access, breach of security, or interception of information caused by factors beyond the Site’s reasonable control, including actions of third parties, hacking, malware, or telecom/network failures. Users acknowledge that information shared on the Platform may be viewed by other Users/third parties depending on privacy settings and the nature of the Services.
13.6. The Site shall not be liable for any failure or delay in performance to the extent caused by events beyond its reasonable control, including acts of God, flood, fire, earthquake, epidemic/pandemic, war, terrorism, civil unrest, labour disputes, governmental actions, court orders, power failures, internet/telecom outages, cyberattacks, or failures of third-party service providers (“Force Majeure”).
13.7. Unless expressly stated otherwise in writing by the Site, the Sites’s obligation is limited to providing access to the Platform and its features (as made available by the Site) for the relevant period, if any. Any reference to usage limits, caps, credits, impressions, views, or similar metrics (if applicable) shall only indicate an upper limit for consumption/availability and shall not create any additional performance obligation or guarantee any outcome, leads, conversions, or Transactions.
14. Indemnity:
14.1. The User hereby agrees to indemnify, hold harmless, and settle any third-party lawsuit or proceeding brought against the Site or any of its directors, employees, or Key Managerial Personnel in relation to any claim arising from the advertisement, wrongful posting of land, unauthorized posting of land, or the fact that the User Content, Site, and/or User features infringe or tend to infringe any copyright, trade secret, or trademark of such third party, or that the content of such post or advertisement is in any manner inconsistent with or in breach of any existing agreement or law as applicable in India.
14.2. The User further unconditionally agrees to indemnify, reimburse, and hold harmless, without objection, the Site, its officers, directors, employees, and agents from and against any claims, actions, demands, liabilities, losses, or damages whatsoever arising from or resulting from their use of Site, whether directly or indirectly.
15. Disclaimer:
15.1. This site is a purely listing-based service and does not function as a broker, intermediary, or facilitator of property transactions. All information provided on this platform is submitted by third-party brokers or agents, and the platform does not verify or endorse any of the listings.
15.2. Users are strongly advised to conduct their own due diligence and seek appropriate legal advice before making any decisions based on information found on this website. The platform shall not be liable for any direct or indirect loss, damages, or legal consequences arising from reliance on inaccurate, incomplete, or false information posted by third parties.
15.3. All legal documentation, property images, and additional content uploaded by brokers are their sole responsibility and should be verified and authenticated by the brokers themselves. The platform assumes no liability for any such material.
16. Suspension and Termination:
The Site may at its own discretion suspend/terminate access for breach, suspected fraud, legal requests, or platform security reasons.
17. Governing Laws and Dispute Resolution:
17.1. If any dispute arises between the User, and the Site arising out of the use of the Site r thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these terms and conditions, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party. Decision of the Arbitrator shall be final and binding on both the parties to the dispute. The place of arbitration shall be Mumbai. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings.
17.2. Subject to the Arbitration clause hereinabove, it is agreed that the Courts in Mumbai shall have exclusive jurisdiction with respect to all matters pertaining or relating to this Agreement.
